The Socratic Med/Arb Method –
An Effective Dispute Resolution Procedure Explained
I describe my approach to Med/Arb as the ‘Socratic’ non-evaluative method. By this procedure the Mediator does not follow the practices of an ordinary Mediation, or those permitted by the ADRIC Med/Arb Rules (e.g. caucusing, knowledge of offers, evaluative comments).
The objective of the Socratic Mediation is to bring forth decisional information that the parties agree can be integrated into the Arbitration procedure, but additionally serves to encourage settlement.
I provide an outline of my reasoning in support of the ‘Socratic’ non-evaluative Mediation methodology for those who may be interested in retaining my services to conduct a Med/Arb conference.
